I. Introduction
Inspiral IP PLLC (“Inspiral”) is committed to a high level of client service. Inspiral believes that part of this commitment includes clear communication about its fee structure and refunds. Information regarding refunds for consultations, flat fee matters, retainer/hourly matters, and other details are each explained below.
II. Refunds for Consultations
Payments for consultations are non-refundable once the consultation meeting has started. If the consultation meeting is cancelled with at least four hours’ notice, the consultation fee may be credited towards a reschedule at Inspiral’s reasonable discretion. Please note that no attorney-client relationship is formed through a consultation booking. An attorney-client relationship is formed with Inspiral upon the execution of Inspiral’s fee agreement signed by both parties.
III. Refunds for Flat Fee Matters
Payments for flat fee matters are considered earned in their entirety when Inspiral’s fee agreement is executed by both parties and the initial fee is paid. For matters that require completion and submission of an application and filing fee to a governmental or administrative entity (such as the USPTO or WIPO), only governmental filing fees will be refunded.
IV. Refunds for Retainer Fee/Hourly Matters
Inspiral currently uses a flat fee structure for its services. In the future, Inspiral may offer hourly services captured in a Retainer Fee Agreement. This means that a fee is paid to Inspiral in advance of service and placed into a client trust account. Inspiral will then deduct its hourly fees as work is performed. Inspiral will send a monthly invoice of its fees and costs for the client to review and correct. Once any changes are made, Inspiral will deduct the invoiced fees.
- Final Invoices and Reimbursed Retainer Fees
If the client’s matter is completed, there are outstanding fees and costs, and no monies in the client’s trust account, the client will receive a final invoice from Inspiral for final fees and costs. If the client’s matter is completed, all outstanding fees and costs are paid, and monies still remain in the client’s trust account, those monies are considered unearned fees. Inspiral will promptly return all unearned fees to the client.
- Refunds Versus Reimbursements
Refunds are separate from the processes described above. Refunds are typically the result of an after the fact fee dispute, accounting error, or a dispute about the quality of legal services performed.
Inspiral will process all refund requests. Inspiral will send a written response within thirty days either: (A) denying the request; (B) requesting more information; or (C) granting the request. This decision will be based on Inspiral’s reasonable discretion.
V. Payment Method and Refund Processing
Any available refunds will only be issued to the original payor using the original payment method. Please allow seven to ten business days for refund processing.
